Information on Legal & Court Referral Sources

This page provides attorneys and authorized legal professionals with an overview of referral procedures, evaluation processes, and professional practices for mental health evaluations conducted through Vital Pathway Strategic Evaluations (VPSE).

All services are evaluation-only and are conducted with professional neutrality, ethical role separation, and adherence to applicable legal and licensure standards.

Initial Consultation (For Attorneys & Immigration Matters)

VPSE offers an initial consultation, typically 15–30 minutes, to discuss case details and determine whether a formal mental health evaluation is appropriate.

For immigration-related evaluations, this consultation is often provided at no cost and may involve the attorney, the evaluation subject, or both.

Purpose of the Initial Consultation

The consultation is informational and evaluative in nature and is used to:

  • Review the type of immigration or legal matter (e.g., Asylum, Extreme Hardship, U-Visa, T-Visa, VAWA)
  • Explain the mental health evaluation process and scope
  • Assess whether a formal psychological evaluation is likely to support the identified legal requirements
  • Clarify timelines, documentation needs, and next steps

This consultation does not constitute treatment, counseling, or the initiation of a therapeutic relationship.

Pre-Evaluation Requirements

Prior to the initiation of any formal evaluation, the following are required:

  • Valid government-issued identification
  • Completion of required intake forms and background questionnaires
  • Submission of relevant collateral documentation, when available (e.g., declarations, police reports, medical or mental health records)

These materials allow for appropriate preparation and ensure the evaluation is conducted within the scope of the legal referral.

Pre-Evaluation Requirements

Step 1: Initial Referral Inquiry

Attorneys may contact VPSE by phone or email to discuss the referral question, jurisdictional considerations, potential conflicts of interest, and anticipated timelines.

Step 2: Referral Information Submission

Attorneys complete the secure Online Referral Form, which includes:
> Evaluation subject’s name and date of birth
> Case type and legal context
> Specific questions the evaluation is intended to address

Step 3: Documentation Review

Relevant collateral materials are reviewed to inform the scope and structure of the evaluation.

Step 4: Scheduling

Once the referral is accepted, VPSE staff coordinates scheduling directly with the evaluation subject (and interpreter, if required).

Immigration Evaluation Process

Immigration mental health evaluations are typically conducted across two separate evaluation days and often involve multiple hours of structured assessment.

Structure of Immigration Evaluations

  • Evaluations are commonly conducted over 2–3 sessions
  • Sessions typically last 60–90 minutes each

The overall evaluation process often spans 2–3 hours or more, depending on complexity

Focus of the Evaluation

The evaluation is structured to address:

  • The specific type of immigration evaluation requested
  • Relevant psychological symptoms or conditions
  • Trauma exposure and functional impact
  • Factors pertinent to the identified legal criteria

Typical Timeline

  • Initial Consultation: 15–30 minutes
  • Pre-Intake Completion: Intake forms and questionnaires completed shortly after consultation
  • Formal Intake Session: Typically scheduled within days to weeks of consultation; initial session often lasts 1–2 hours
  • Additional Sessions: Conducted as needed based on evaluation scope

Report Completion: Generally, 2–4 weeks following the final evaluation session, subject to documentation completeness and case complexity

Evaluation Methodology

Evaluations may include:

  • Structured clinical interviews
  • Standardized, objective assessment instruments
  • Review of collateral records
  • Consideration of cultural, linguistic, and contextual factors

All methods are selected based on the referral question and are applied with professional neutrality.

Professional Boundaries

VPSE provides MENTAL HEALTH EVALUATIONS ONLY. Psychotherapy, counseling, treatment, supervision, and advocacy services are not offered to individuals who are the subject of an evaluation, in accordance with ethical standards prohibiting dual relationships.
